Divine trademark dispute
Heather Saxena TELEHEALTH corporate Eucalyptus is embroiled in a legal battle with the Uniting Church over the name of its online weight loss program Juniper, with the church alleging it holds the trademark.
Uniting Church Homes( UCH) runs medical, pharmacy and psychology services, aged care facilities, accommodation and community care under the Juniper name.
It is seeking as yet unquantified damages from Eucalyptus, alleging the telehealth has been misusing its trademark in promoting Juniper.
According to a claim lodged in the Federal Court of Australia, the telehealth provider is accused of profiting off the“ valuable reputation and substantial goodwill” that UCH has built over the years and is“ passing off” its Juniper health services as being run or approved by UCH.

Eucalyptus said it had been using the Juniper name in‘ good faith’.
UCH also accused Eucalyptus of misleading or deceptive conduct by representing in WA that its services were affiliated with UCH.
In its defence, Eucalyptus admitted its Juniper sign was“ substantially identical” to the UCH trademark.
However, it denied using the trademark— which was registered in WA back in 2012— without authorisation or being involved in deceptive or misleading conduct, stressing it had been using the Juniper name in“ good faith”.
The company will argue that the UCH trademark is linked to healthcare services“ provided from facilities physically located in WA”, with no crossover with online services provided Australia wide by Eucalyptus’ Juniper.
The telehealth also lodged a crossclaim, seeking to have the church’ s trademark removed from the trademark register for“ non-use”, given its use was restricted to WA.
A mediation hearing is scheduled for 29 August.
