Colorado’ s 2025 Housing Laws Reshape Landlord-Tenant Dynamics & Operational Costs

New Legislation Introduces Pricing Transparency Requirements, Tenant Rights Expansions, And Increased Government Oversight, Signaling A Shift In Housing Policy Statewide.

Ronald Reagan put it bluntly in 1986,“ The nine most terrifying words in the English language are ' I’ m from the government and I’ m here to help.'” The Colorado legislature should consider that quote before they make any more changes to the laws that impact property owners, housing providers, and tenants. Since 2020, the government has done more to interfere with the housing market, in the name of providing protections to those who rent, when really they are creating policies that hurt the supply of housing, and make it more expensive to be a landlord. The impact of the 2025 laws will be felt in Colorado this year and for years to come. Here is a quick snapshot highlighting laws you need to know and discuss in more detail with your legal counsel so you and your team can be prepared.

The biggest alteration that will impact the business of providing housing has to be HB 25-1090. The bill is not on its face called rent control, but it does have an impact on what can be charged to tenants as a separate fee. Specifically, limiting charge backs of taxes, costs to maintain common areas of properties, and costs associated with a landlord ' s obligation to provide a habitable home. Landlords are also limited to charging tenants for the actual cost of utilities for a tenant’ s unit, which can present a significant change in operations if the unit is not individually metered.
By limiting these items, the legislature is not lowering the cost of housing, but dictating what can be specifically passed along to the tenant as a separate fee. Landlords are not getting relief
