energy conservation standards in residential equipment and appliances. In total, these aggressive energy standards fail to consider the hardship imposed on the rental housing industry and, by extension, challenges to housing supply.
Section 3 aims to streamline federal permitting requirements by providing guidance on the implementation of the National Environmental Policy Act of 1969 and section 106 of the National Historic Preservation Act in a manner that maximally exempts or reduces burdens on housing development.
Section 4 directs the Secretary of Housing and Urban Development( HUD) to develop regulatory best practices for state and local governments to promote housing construction and affordability. The order mentions several examples, including:
• Capping permitting timelines and fees;
• Limiting retroactive application of new or changed building codes;
• Allowing third-party inspections and appropriate builder choice on certified entities for inspections and studies;
• Ensuring swift dispute resolution with government agencies and private parties regarding construction matters;
• Reducing green-energy building requirement and“ nonevidence-based” building codes; and
• Reducing restrictions on the use of manufactured or modular housing.
NAA strongly supports a reduction of state and local barriers to housing development, notably through our advocacy on the Identifying Regulatory Barriers to Housing Act and the Housing Supply Frameworks Act, both of which would enable and incentivize state and local governments to reexamine zoning, land use and other regulations that increase the cost of housing.
Section 5 instructs the HUD and Treasury Secretaries to align Opportunity Zone tax credits to expand investment in singlefamily home construction.
