**The ICRC may order multiple outcomes in a particular case, i.e.,
advice and an undertaking. Here, we report only the strongest
action against the doctor, i.e., the undertaking.
Remedial Agreements
Under the new transparency initiative (which is described on page 27), the ICRC proposes Remedial Agreements
in low risk cases where minor education needs are identified, and where the Committee would like confirmation
(follow-up) that those needs have been addressed by the physician. Remedial Agreements began being proposed on
June 1, 2015.
Incapacity Inquiries
Following the completion of an incapacity inquiry, the ICRC has the power to refer the matter of the member’s
capacity to the Fitness to Practise Committee, if appropriate and if the matter has not been addressed through an
undertaking with the College or a monitoring agreement with the Physician Health Program.
If a matter has been referred to the Fitness to Practise Committee and the ICRC is of the opinion that the member’s condition exposes or is likely to expose patients to harm or injury, it may also direct the Registrar to impose
terms and conditions upon or suspend a member’s certificate of registration.
In 2015, the ICRC referred two physicians to the Fitness to Practise Committee for incapacity concerns.
