Recommended policy changes presented
General Counsel Paul Cady recommended changes in two policies regarding data privacy
in an ongoing effort to ensure that district policies comply with changes in law. In both cases, the revised changes are based on Minnesota School Boards Association model policies.
The first policy, Public and Private Personnel Data, includes a number of minor detail
changes and a couple substantive changes. One reflects recent legislative and court decisions regarding privacy of data for public employees who have recently resigned or been
terminated following complaint or investigation. Another adds provisions for sharing data
related to maltreatment or sexual assault.
The second policy, Protection and Privacy of Pupil Records, includes a number of significant changes including provisions related to release of records to military, allowing
electronic signatures for release of data, ensuring that contractors working for the district
protect privacy of pupil records, provisions for verifying identification of individuals who
request student data, and more.
The board is expected to approve the policies at the next meeting as part of the consent
agenda.
