STORAGE Fire regulations in most exhibit facilities prohibit storing product , literature , empty packing containers or packing materials behind back drapes or under draped tables . Exhibitors may store a limited supply of literature or product appropriately within the booth area , so long as these items do not impede access to utility services , create a safety problem or look unsightly . ISPA determines acceptability of persons , things , conduct and / or printed matter and reserves the right to request the removal of unsightly boxes , bags , collateral , product , etc . from the exhibit floor at the expense of the exhibitor .
AMERICANS WITH DISABILITIES ACT All exhibiting companies are required to be in compliance with the Americans with Disabilities Act ( ADA ) and are encouraged to be sensitive , and as reasonably accommodating as possible , to attendees with disabilities .
INSURANCE Insurance liability is the full and sole responsibility of the exhibitor . Each party ( the “ Indemnifying Party ’’) shall at all times protect , indemnify , defend , and keep the other party , its affiliated and related entities , and their respective agents , business invitees , contractors , directors , employees , officers , representatives , and shareholders harmless from and against any and all losses , costs , damage , liability , or expenses ( including reasonable attorney ’ s fees and defense costs ) the indemnified party may suffer as the result of any third party claims , demands , costs , or judgments to the extent arising from , out of , or related to the Indemnifying Party ’ s occupancy and use of the exhibit premises or part thereof , as well as the acts or omissions of the Indemnifying Party , its agents , business invitees , contractors , directors , employees , officers , representatives , or shareholders including , without limitation , their negligence , recklessness , or willful misconduct . ISPA and GES are not responsible for lost or stolen Items .
EXHIBITOR DISPUTES If any exhibitor has any legal or other disputes with another person or entity , that exhibitor is responsible for making sure that the dispute in question will not affect the exhibition , ISPA or its management of the exhibition in any way . ISPA will have no duty to take or to refrain from taking action of any kind with regard to any such dispute . All exhibitors expressly agree to indemnify ISPA for any costs , including attorney fees , which it might incur if this agreement is violated .
CANCELLATION OF SHOW In the event of fire , strikes , health pandemics or other uncontrollable circumstances rendering the exhibit area unfit , unavailable for use or causing the exhibition to be canceled prior to the opening date of the event , this contract will not be binding and payments toward the exhibit rental will be refunded . Exhibitors will be solely responsible for any expenses ( i . e . freight , booth structures , employee travel , etc .) beyond the contracted exhibit rental fee incurred .
