Harassment : Unwanted behaviors that target someone ’ s race or ethnicity , gender identity , or sexuality that create an intimidating , hostile , or offensive work environment ( Siena ).
Conduct directed toward a victim that includes , but is not limited to , repeated , or continuing unconsented contact that would cause a reasonable individual to suffer emotional distress that actually caused the victim to suffer emotional distress . Harassment does not include constitutional protected activity or conduct that serves a legitimate purpose ( State of Michigan ).
Unwanted sexual behavior , advances , or requests for favors . Unwelcomed verbal , visual , or physical sexual conduct . Offensive , severe , and / or frequent remarks about a person ’ s sex . Harassment of a sexual nature which interferes with an individual ’ s right an education and participating in a program or activity ( Title IX ).
Hostile Environment : is one in which unwelcome conduct of a sexual nature creates an uncomfortable , intimidating , hostile , or offensive environment ( Siena ).
Hate Crime ( bias crime ): A criminal offense that manifests evidence that the victim was intentionally selected because of the perpetrator ’ s bias against the victim . For the purposes of Clery , the categories of bias include the victim ’ s actual or perceived race , religion , gender , gender identity , sexual orientation , ethnicity , national origin , and disability ( Clery ).
Hazing : any action or situation , whether on or off University premises , which :
• Endangers the mental health , physical health , or safety of a person ,
• Embarrasses , frightens , or degrades a person ,
• Destroys or removes public or private property
For the purposes of initiation , admission into , affiliate with , or as a condition of continued membership in a student organization , group , or team regardless of an individual ’ s willingness to participate ( Clery ).
Intimidation : To unlawfully place another person in reasonable fear of bodily harm through the use of threatening words and / or other conduct , but without displaying a weapon or subjecting the victim to actual physical attack ( Clery ).
Larceny-Theft : The unlawful taking , carrying , leading , or riding away of property from the possession or constructive possession of another . Constructive possession is the condition in which a person does not have physical custody or possession , but is in a position to exercised dominion or control over a thing ( Clery ).
Liquor Law Violations : The violation of state or local laws or ordinances prohibiting the manufacture , sale , purchase , transportation , possession , or use of alcoholic beverages , not including driving under the influence and drunkenness . Include in this classification : the manufacture , sale , transporting , furnishing , possessing , etc . of intoxicating liquor ; maintaining unlawful drinking places ; bootlegging ; operating still ; furnishing liquor to a minor or intemperate person ; using a vehicle for illegal transportation of liquor ; drinking on train or public conveyance ; and attempts to commit any of the above ( Clery ).
