ABSTRACT
As the statistics for the North, Central and South America and the Caribbean show, human
trafficking is at an alarming rate, particularly in terms of sexual and labor exploitation,
although the latter is on a smaller scale. The need for prevention and protection of possible
victims compelled the Inter-American Court of Human Rights to release two Advisory
Opinions - although the former consultation was not directly related to human trafficking,
but had it as its consequences - in order to guarantee the protection of human beings in
contexts of forced migration. In this sense, the profile of victims and perpetrators also
reveals the regional profile of human trafficking and exposes a serious reality on the
continent. Based on the data analyzed, using the hypothetical-deductive methodology and
bibliographic survey, what is the current scenario of protection for women and children
in the Americas, in the decades following the Palermo Protocol and how does this
translates into the advisory jurisprudence of the Inter-American Court of Human Rights?

1. INTRODUÇÃO
O Protocolo Adicional à Convenção das Nações Unidas contra o Crime
Organizado Transnacional Relativo à Prevenção, Repressão e Punição do Tráfico de
Pessoas, adotado no ano de 2000, possui um recorte temático específico, referente a
mulheres e crianças, em razão dos alarmantes números representados por essas duas
categorias de pessoas, nas estatísticas de seres humanos traficados, sobretudo nesse início
de século.
